Terms of Use
These Terms of Use govern access to and use of the CourseMatch website at https://www.coursematch.au/, the CourseMatch platform, dashboard and related online services, and any content, tools, assessments, recommendations and functionality made available through them, by CourseMatch Pty Ltd (ACN 693 408 409) ("CourseMatch", "we", "us" or "our").
By accessing or using the website or Platform, a user agrees to be bound by these Terms. If a user does not agree to these Terms, that user must not access or use the website or Platform.
These Terms should be read together with the Privacy Policy, the Cookie Policy, any Collection Notice or additional terms presented at the point of registration or use, and where applicable, any separately signed agreement between CourseMatch and a school or institutional customer.

1. Who We Are

2. Nature of the Service
2.1 Educational guidance platform
CourseMatch is an educational guidance platform designed to help students explore post-school study and career pathways through structured self-assessment and AI-assisted recommendation tools.
2.2 No professional advice
The Platform and all results, outputs, reports, summaries and recommendations are provided for general educational guidance only.
They do not constitute:
- professional career advice;
- academic counselling;
- psychological advice;
- admissions advice; or
- a guarantee of entry to any course, institution or career pathway.
2.3 No guaranteed outcomes
CourseMatch does not warrant that use of the Platform will result in:
- any particular course recommendation being suitable for a user;
- admission to a university, TAFE or other institution;
- any employment, career or study outcome; or
- any particular personal, academic or vocational result.
3. Direct Collection and Schools
CourseMatch collects personal information directly from students and determines the purposes and means of handling that information.
Schools may facilitate access to the Platform, but:
- schools do not provide student personal information to CourseMatch as part of the ordinary operating model;
- schools do not determine how CourseMatch handles information collected through the Platform; and
- schools do not act as a data controller or processor in relation to CourseMatch-held student data.
Where access to the Platform is provided through a school, school trial or school licence arrangement, the relevant school may facilitate access to the Platform. However, the student's relationship with CourseMatch in respect of the Platform remains subject to these Terms and CourseMatch's privacy documentation.
4. Eligibility and Access
4.1 Intended users
The Platform is intended for use by secondary school students, including students aged 15 years and over, and may also be used by schools, teachers, counsellors or other authorised persons in connection with school access arrangements.
4.2 Authority to use
By using the Platform, a user represents that:
- the user is authorised to access and use the Platform;
- any information provided to CourseMatch is accurate and complete; and
- where the user is under 18, any parental, guardian or school authorisation required under applicable policies or law has been obtained.
4.3 Account requirement
Some features of the Platform require a user account. A user must not access restricted areas of the Platform without a valid account.
5. Minors and Authorisation
Where a user is under 18, CourseMatch relies on the user, the user's school and/or the user's parent or guardian, as applicable, to ensure that appropriate authorisation has been obtained for the collection, use and disclosure of personal information, including overseas disclosure and AI-assisted processing.
6. Accounts and Account Security
6.1 Registration
To create an account, a user may be required to provide information including name, email address, date of birth, year group and other registration details.
A user must provide current, accurate and complete information.
6.2 Account responsibility
A user is responsible for:
- maintaining the confidentiality of login credentials;
- all activity carried out through the user's account; and
- ensuring that no other person accesses the Platform through that account.
6.3 Prohibited account sharing
Accounts are personal and must not be:
- shared;
- transferred;
- sold; or
- used by another person.
6.4 Security notifications
If a user becomes aware of unauthorised access to an account or any security issue affecting the Platform, the user must notify CourseMatch promptly at contact@coursematch.au.
7. Acceptable Use
A user must use the website and Platform only for lawful purposes and in a manner consistent with these Terms.
A user must not:
- use the Platform in a way that is unlawful, misleading, abusive, defamatory, harassing or harmful;
- impersonate another person or misrepresent identity, age, authority or affiliation;
- interfere with or disrupt the operation, security or integrity of the website or Platform;
- attempt to gain unauthorised access to any account, system, network or data;
- upload, transmit or introduce malware, malicious code or harmful material;
- copy, scrape, extract, harvest or systematically download content or data from the Platform;
- reverse engineer, decompile or attempt to derive source code, prompts, models, scoring logic or methodology from the Platform;
- use bots, scripts, automation or similar means to access or interact with the Platform without written approval;
- use the Platform for commercial exploitation, resale or competitive analysis; or
- use the Platform in a way that infringes any person's rights, including privacy or intellectual property rights.
CourseMatch may monitor use of the Platform to the extent reasonably necessary to protect the Platform, users and CourseMatch's rights.
8. Student Inputs and User Content
8.1 User-provided content
A user may submit or enter information into the Platform, including:
- assessment responses;
- career and study preferences;
- written aspirations and goals;
- feedback; and
- other content or material provided through Platform features.
That content is referred to in these Terms as "User Content".
8.2 Responsibility for User Content
The user is responsible for User Content submitted through the account, including ensuring that it:
- is accurate to the best of the user's knowledge;
- does not infringe another person's rights; and
- does not contain unlawful, abusive, misleading or inappropriate material.
8.3 Licence to CourseMatch
To the extent necessary to operate the Platform and provide its services, the user grants CourseMatch a non-exclusive, worldwide, royalty-free licence to host, store, use, reproduce, process and analyse User Content for the purposes described in these Terms, the Privacy Policy and any applicable Collection Notice.
8.4 Removal of content
CourseMatch may remove or restrict access to User Content if CourseMatch reasonably considers that the content:
- breaches these Terms;
- may create legal or regulatory risk;
- may compromise Platform security or integrity; or
- is otherwise inappropriate for the Platform.
9. AI-Assisted Features
9.1 AI-assisted outputs
The Platform uses AI-assisted processes to generate certain outputs, including:
- written summaries of personality, trait and career results;
- suggested responses to study survey questions based on previous results; and
- final course recommendations.
9.2 Nature of AI outputs
AI-assisted outputs are generated based on user inputs, assessment responses and CourseMatch systems. Such outputs may not always be complete, accurate or suitable for every user.
9.3 No sole reliance
Users should not rely solely on AI-assisted outputs when making significant education, course selection or career decisions.
9.4 Third-party AI provider
As described in the Privacy Policy, selected assessment responses may be processed using OpenAI's API in the United States for the purposes of generating recommendations and related outputs.
9.5 Automated decision-making
CourseMatch does not make automated decisions that have legal or similarly significant effects. Recommendations are indicative only and do not determine eligibility, admission, enrolment, employment or other outcomes.
10. Privacy
CourseMatch handles personal information in accordance with:
- the Privacy Act 1988 (Cth);
- the Australian Privacy Principles;
- the CourseMatch Privacy Policy; and
- any applicable Collection Notice.
By using the website or Platform, a user acknowledges that personal information may be collected, used, stored and disclosed as described in those documents.

11. Cookies and Session Technologies
CourseMatch uses cookies and similar technologies only as described in its Cookie Policy.
At the date of these Terms, CourseMatch uses cookies only for essential session management and Platform functionality and does not use advertising, analytics or third-party tracking cookies.
12. Intellectual Property
12.1 CourseMatch ownership
CourseMatch owns, or is licensed to use, all rights, title and interest in the website, Platform and their contents, including:
- software;
- platform design;
- assessments;
- methodology;
- scoring logic;
- text;
- graphics;
- branding;
- reports;
- recommendations;
- compilations; and
- underlying intellectual property rights.
12.2 No transfer of rights
Nothing in these Terms transfers any intellectual property rights to a user.
12.3 Limited licence to users
Subject to these Terms, CourseMatch grants each user a limited, non-exclusive, non-transferable, revocable licence to access and use the website and Platform for personal, educational and non-commercial purposes.
12.4 Restrictions
A user must not, without CourseMatch's prior written consent:
- reproduce, distribute or republish Platform content;
- modify or create derivative works from the Platform or its outputs;
- use CourseMatch branding, logos or trade marks; or
- use any content from the Platform for commercial purposes.
13. Feedback
If a user provides feedback, suggestions or ideas about the website or Platform, CourseMatch may use that feedback without restriction and without payment or attribution, provided that CourseMatch handles any associated personal information in accordance with its Privacy Policy.
14. Third-Party Information and Links
14.1 Third-party content
The Platform may refer to or provide information about:
- universities;
- TAFEs;
- courses;
- institutions;
- career pathways; or
- third-party websites and services.
Such information may change over time and may not always be complete, current or accurate.
14.2 No endorsement
A reference to a third party, institution or course does not constitute:
- endorsement;
- sponsorship;
- approval; or
- a representation that any course or institution is appropriate for a particular user.
14.3 Third-party websites
If the website or Platform contains links to third-party websites, CourseMatch is not responsible for the content, privacy practices, terms or operation of those websites.
15. Availability, Changes and Suspension
15.1 Availability
CourseMatch will use reasonable endeavours to keep the website and Platform available, but does not guarantee uninterrupted or error-free access.
15.2 Changes to services
CourseMatch may at any time:
- update, modify or improve the Platform;
- add or remove features;
- change content, assessments or recommendation methods; or
- suspend or discontinue part or all of the Platform.
CourseMatch may also update practices, processes or features to comply with changes in law or regulatory guidance.
15.3 Suspension or restriction
CourseMatch may suspend, restrict or terminate access to the website or Platform immediately if CourseMatch reasonably considers that:
- a user has breached these Terms;
- there is a security, integrity or legal risk;
- maintenance or system changes are required; or
- suspension is reasonably necessary to protect CourseMatch, users or third parties.
16. Termination of Access
16.1 Termination by user
A user may stop using the website or Platform at any time. A user may also delete the account in accordance with CourseMatch's platform settings and Privacy Policy.
16.2 Termination by CourseMatch
CourseMatch may terminate or disable a user account, or access to all or part of the Platform, if:
- the user breaches these Terms;
- the account is used in a way that creates legal, safety or security risk;
- the Platform is no longer made available under a relevant school or commercial arrangement; or
- CourseMatch reasonably decides to discontinue the relevant service.
16.3 Effect of termination
On termination of access:
- the user's right to access the affected parts of the Platform ceases;
- CourseMatch may disable login access; and
- personal information may continue to be retained and handled in accordance with the Privacy Policy and applicable law.
17. Disclaimers
17.1 As is and as available
To the maximum extent permitted by law, the website and Platform are provided on an "as is" and "as available" basis.
17.2 No warranty
To the maximum extent permitted by law, CourseMatch does not warrant that:
- the website or Platform will be uninterrupted, secure or error-free;
- the Platform will always be available at any particular time;
- any output, recommendation or content will be complete, accurate, current or fit for a particular purpose; or
- any defects will always be capable of correction.
17.3 Educational use only
Users acknowledge that the Platform is intended as an educational guidance tool only and is not a substitute for independent decision-making or professional advice.
Nothing in these Terms excludes any non-excludable rights under the Australian Consumer Law or other applicable law.
18. Limitation of Liability
18.1 Exclusion of indirect loss
To the maximum extent permitted by law, CourseMatch is not liable for any indirect, incidental, special, consequential or punitive loss or damage, including:
- loss of opportunity;
- loss of anticipated benefits;
- loss of data;
- reputational loss; or
- disappointment with any recommendation or outcome,
arising out of or in connection with the use of, or inability to use, the website or Platform.
18.2 Liability cap
To the maximum extent permitted by law, CourseMatch's total aggregate liability arising out of or in connection with these Terms, whether in contract, tort, including negligence, under statute or otherwise, is limited to:
- where the user has paid fees to CourseMatch for the relevant service, the amount paid by that user for that service in the 12 months before the event giving rise to the claim; or
- where no fees have been paid, AUD $100.
18.3 Non-excludable rights
Nothing in these Terms excludes, restricts or limits any right or remedy that cannot lawfully be excluded, restricted or limited, including rights under the Australian Consumer Law.
19. User Responsibility and Indemnity
To the extent permitted by law, a user is responsible for loss suffered by CourseMatch to the extent caused by the user's fraud, wilful misconduct, unlawful use of the website or Platform or breach of these Terms.
To the extent permitted by law, a user indemnifies CourseMatch against loss, damage, cost or liability suffered or incurred by CourseMatch arising from:
- the user's breach of these Terms;
- misuse of the website or Platform by the user; or
- User Content submitted by the user that infringes another person's rights or breaches law.
This clause does not apply to the extent that the loss was caused or contributed to by CourseMatch's own breach of law, negligence or wilful misconduct.
If the user is under 18, this clause applies only to the extent enforceable under applicable law.
20. School and Organisational Terms
Where a user accesses the Platform through a school, institution or organisation:
- the user's access may also be affected by arrangements between CourseMatch and that school, institution or organisation;
- CourseMatch may suspend or end school-based access if the relevant school or institutional arrangement ends; and
- unless expressly stated otherwise, those arrangements do not give the school or institution access to the user's individual assessment results or personal information.
If there is any inconsistency between these Terms and a separately signed agreement between CourseMatch and a school or institutional customer, that separate agreement prevails to the extent of the inconsistency as between those contracting parties.
21. Changes to These Terms
CourseMatch may update these Terms from time to time to reflect changes in:
- the website or Platform;
- legal or regulatory requirements;
- privacy or security practices; or
- business operations.
If CourseMatch makes a material change, notice may be given by:
- publication on the website;
- a notice on the Platform; or
- email, where appropriate.
Continued use of the website or Platform after updated Terms take effect constitutes acceptance of the updated Terms.
22. Hierarchy
If a separately signed agreement applies between CourseMatch and a school or organisation, that signed agreement prevails as between those contracting parties to the extent of inconsistency.
As between CourseMatch and individual users:
- the Collection Notice prevails to the extent of any inconsistency concerning point-of-collection disclosures;
- the Privacy Policy prevails to the extent of any inconsistency concerning handling of personal information; and
- the Cookie Policy prevails to the extent of any inconsistency concerning cookies and similar technologies.
23. Governing Law
These Terms are governed by the laws of Queensland, Australia.
Users submit to the non-exclusive jurisdiction of the courts of Queensland and courts competent to hear appeals from them.
24. General
24.1 Entire terms
These Terms, together with any applicable privacy documentation and any additional terms presented at the point of use, form the entire agreement between CourseMatch and the user in relation to the website and Platform, except to the extent a separate signed agreement applies.
24.2 Severability
If any provision of these Terms is invalid, illegal or unenforceable, that provision is to be read down to the extent necessary, and if that is not possible, severed, without affecting the remaining provisions.
24.3 Waiver
A failure or delay by CourseMatch to exercise a right under these Terms does not operate as a waiver of that right.
24.4 Assignment
A user must not assign or transfer any rights under these Terms without CourseMatch's prior written consent.
CourseMatch may assign or novate its rights and obligations under these Terms as part of a corporate restructure, sale, transfer of business or similar transaction.
24.5 Electronic acceptance
These Terms may be accepted electronically, including by:
- use of the website or Platform;
- clicking an acceptance box;
- creating an account; or
- continuing to access the service after notice of updated Terms.
